COVID-19 Update

It is business as usual here at Capella IP.

 

We are monitoring updates from global health organisations and the British and Scottish governments as the COVID-19 situation develops and are following the official guidance on containing the spread of the virus.

 

All our staff are fully equipped and working from home using our secure document management system and following our rigorous client confidentiality practices. We have a robust continuity plan in place. We are operating at normal capacity but in slightly different surroundings.

A notice issued on 15 March extends all EPO (and some PCT) deadlines until 17 April 2020.

As a state in which the European Patent Office is located the Federal Republic of Germany, like many other Contracting States, is experiencing …. a general dislocation within the meaning of Rule134(2) EPC. Periods expiring on or after the date of the publication of this notice are thus extended for all parties and their representatives to 17 April 2020.

Whilst this is helpful if applicants are prevented from responding, we would recommend responding to the EPO deadlines as normal where possible, to reduce a risk of deadlines piling up later.

UK IP Office - Coronavirus advice for rights applicants

The Intellectual Property Office (IPO) has robust plans in place to maintain services for customers applying for rights during the Coronavirus outbreak.

USPTO – USPTO notices regarding COVID-19

The USPTO offices are closed to the public. Patent applicants will be able to file a petition to revive and the PTO will waive the fee for those “who were unable to timely reply to an Office communication due to the effects of the coronavirus outbreak, which resulted in the application being held abandoned or the reexamination prosecution terminated or limited.”
