The Unitary Patent and Unified Patent Court Agreement - when will it start?
Here we are almost at the end of September and the Unitary Patent (UP) and UPC Agreement (UPCA) have not yet come into force. Will we have news by the end of September?
We are waiting for Germany to deposit its instrument of ratification leading to a Sunrise Period on the first day of the fourth month after that deposit. The earliest it can now come into force is 1st January; some are predicting Spring 2023, others the second quarter.
Remember, it is important for businesses to plan their strategy for classic EP bundle patents and EP patent applications and whether to opt out or not, ready for the Sunrise Period.
